PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS SITE. 

Article 1 – Scope

 

1.1. The company OLIMPE (a French société par actions simplifiée incorporated under the laws of France, having its registered office at 86-90 Rue du Dôme – 92100 Boulogne-Billancourt – France and registered with the Nanterre Trade and Companies Register under the number 829 602 465) (hereinafter “OLIMPE”, “we”, “us” or “our”) owns and operates the website : www.ecmi-olimpe.com (hereinafter the “Site”) related to the European Conference on Microbiota & Infectiology – ECMV (hereinafter the “ECMI Event”) which will take place, online, on March 20ST and 21TH, 2024.

 

1.2. These terms of use and general terms and conditions of sale (hereinafter the “Terms and Conditions”) set forth the legally binding terms on which the users of the Site (hereinafter the “User(s)”, the “Participant(s)”, “you” or “your”) can use the Site and register to the Event. To register to the Event, the Participant must be a health professional or a pharmaceutical industry. Note that, besides its registration to the Event, pharmaceutical industry may enter, within the Event, a partnership with OLIMPE which shall not fall within the scope of these Terms and Conditions.

 

These Terms and Conditions apply to all Users. Your use of the Site indicates your agreement to be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, then do not use the Site.

 

1.3. We may at our sole discretion change, add and/or delete portions of these Terms and Conditions at any time on a going-forward basis. It is your responsibility to check these Terms and Conditions for changes prior to use of the Site. Your continued use of the Site following the posting of changes to these Terms and Conditions implies your acceptance of any changes.

 

 

Article 2 – Registration procedure

 

2.1. To register to the Event through the Site, please proceed as follows :

  • choose the online registration form matching your professional status ;
  • complete, online, the registration form and attach, for Participants other than Doctors and Pharmaceutical representatives, proof of your professional status ;
  • accept the Terms and Conditions and the Data Privacy Policy by clicking on the corresponding checkboxes ;
  • confirm the summary of the registration using the “Confirmation of the order” section ;
  • For pharmaceutical industries, pay online in accordance with article 3 here of and confirm the method of payment via the “Payment” section.

 

The data we collect when confirming your registration to the Event constitute proof of transaction between you and us. You will receive, by email, confirmation of your registration and if need be, an invoice.

Any registration associated with payment by credit card will be considered effective once the online payment organization has given its consent. In case of refusal of the said organization, the registration will be automatically canceled.

2.2. We recommend that you print and / or archive, on a reliable and durable medium as proof, the registration confirmation as well as the electronic invoice.

 

2.3. We reserve the right to refuse any registration from a Participant with whom there is or has been a dispute, in particular with regard to payment for a previous registration. Any incomplete or incorrect registration will not be taken into account.

 

2.4. In any event, regardless of the method of payment, registration will not be validated and therefore effective until the effective receipt of the registration fees. Any registration older than one month and for which no valid payment has been received will be automatically canceled. Any canceled registration will result in a cancellation notice (either directly on the Site when processing the order online, or subsequently by email).

 

2.5. Registration to the Event gives : (i) during the Event, online access to all scientific sessions and a certificate of attendance and (ii) after the Event, streaming access to all scientific sessions.

 

2.6. When confirming a registration, we reserve the right to add the Participant to the mailing list for future events.

 

 

Article 3 – Registration fees – Payment

 

3.1. Registration fees only apply to pharmaceutical industries.

 

The registration fees available on the Site are expressed in Euros, before taxes and all taxes included. The applicable registration fees are those mentioned on the Site at the time of the confirmation of registration. Registration fees are subject to change at any time, in particular due to an introductory offer and promotional campaigns. No registration fees changes shall apply to registrations in process.

Unless specifically stated otherwise, no discount or payment term shall be granted.

3.2. Online registrations are paid online directly on the Site, using a secure payment system. Our payment system has been entrusted to a service provider specializing in secure payments online compliant with the Payment Card Industry Data Security Standard (PCI DSS).

 

 

Article 4 – Modification – Cancellation

 

4.1. Modification

 

OLIMPE reserves the right to modify the Event program, particularly in the absence of a speaker. Any modification affecting the Event will not entail any refund or compensation of any kind.

4.2. Cancellation from any Participant

To all Participants : In the event that, you wish to cancel your participation to the Event, cancellation will not be processed unless we receive an official cancellation request either (i) by mail at : OLIMPE – 86-90 Rue du Dôme – 92100 BOULOGNE BILLANCOURT, France or (ii) by email at : contact@ecmi-olimpe.com. After you have cancelled your registration, you will receive an email to confirm your cancellation at the email address you provided at the time of registration.

 

To pharmaceutical industry specifically : For any cancellation from a pharmaceutical industry received by OLIMPE up to February 21TH, 2024 inclusive, all amounts paid will be refunded after deduction of administrative fees of €30 including tax. Reimbursement will be made after the date of the Event, using the same payment method as used for the registration. For any cancellation received by OLIMPE from February 21TH, 2024, for any reason whatsoever, no refund will be made.

 

4.3. Cancellation from OLIMPE

 

In the event that OLIMPE has no other choice but to cancel the Event, each Participant will be informed as soon as possible. Registration fees will be reimbursed to pharmaceutical industry. As an exception, OLIMPE shall not be held liable and no refund will be made if the Event is delayed or canceled due to a case of force majeure.

 

 

Article 5 – Intellectual Property Rights

 

5.1. The Site and all its contents, including but not limited to articles, other texts, photographs, images, graphics, video and/or audio material broadcast during the Event, presentations from speakers (hereinafter the “Proprietary Material”) are protected by copyright as outlined in articles L.111-1 and following of the French Intellectual Property Code.

 

As a consequence, except for specific permission, each Participant is expressly informed that the Proprietary Material cannot be copied, reproduced, represented, transmitted, passed on or made available, exploited in any way whatsoever and on any medium whatsoever, under penalty of constituting an act of copyright infringement punishable by articles L.335-2 and L.335-3 of the French Code of Intellectual Property.

 

5.2. The semi-figurative French trademark “European Conference on Microbiota & Infectiology” has been filed and registered by the company OLIMPE with the French National Institute of Industrial Property on December 12th, 2022, under the number 4920542. Consequently, any Participant engaging in its representation, reproduction, embedding or distribution incurs the penalties outlined in articles L.713-2 et seq. of the French Intellectual Property Code.

 

Article 6 – Disclaimers

 

6.1. While OLIMPE endeavors to ensure that the Site is normally available 24 hours a day, 7 days a week, OLIMPE reserves the right to do any of the following, at any time, without notice:  (i) to modify, suspend or terminate operation of or access to the Site, or any portion of the Site, for any reason ; (ii) to modify or change the Site, or any portion of the Site, and any applicable policies or terms ; and (iii) to interrupt the operation of the Site, or any portion of the Site, as necessary to perform routine or non-routine maintenance, error correction, or other changes.

 

6.2. The information, content and materials on the Site are provided on an “as-is” and “as-available” basis. OLIMPE does not give any representation and warranty in respect of such information, content and materials. OLIMPE does not warrant that the functions contained in information, content and materials on the Site are accurate, complete or current or will be uninterrupted or error-free, that defect will be corrected or that the Site or server or any software or other device that make such information, content and materials are free of viruses or other harmful components.

Particularly, OLIMPE does not represent and warrant that the content provided during the Event by speakers as well as any comments made during the Event are accurate, reliable, complete. It is the Participant responsibility to ensure the accuracy, correctness, completeness, reliability, safety or otherwise of the aforesaid content and comments.

6.3. Although access to the Site is free of charge, Users shall bear the entire costs of (i) all necessary servicing, repair or correction and (ii) as the case may be, the registration fees to the Event.

The above disclaimer applies to any damages, liability or injuries caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction of or unauthorized access to, alteration of, or use, whether for breach of contract, tort, negligence or any other cause of action.

 

Article 7 – Your Liability

7.1. You undertake (i) to use the Site in accordance with the Terms and Conditions ; (ii) not to disrupt the use of the Site by any other Users ; (iii) not to commit any action likely to risk security issues.

7.2. You undertake not to submit unlawful, defamatory, abusive, obscene, or offensive material to the Site and/or during the Event. You agree that you will not submit anything to the Site and/or during the Event that will or may violate any rights of a third party, including but not limited to copyright, trademark, and/or privacy rights.

7.3. You agree to indemnify, defend, and hold harmless OLIMPE from and against any and all claims, demands, proceedings, suits and actions, including any related liabilities, obligations, losses, damages, deficiencies, penalties, taxes, levies, fines, judgments, settlements, expenses (including legal and accountants’ fees and disbursements) and costs (collectively, the “Claims“), based on, arising out of or resulting from your use of the Site, including without limitation any Claims alleging facts that if true would constitute your breach of these Terms and Conditions.

Article 8 – Our Liability

 Subject to applicable law, we cannot be held liable for any losses, damages or expenses suffered by in connection with the use of any software, application, device or any other material provided to you in connection with your use of the Site or for any loss which is not a direct and reasonably foreseeable consequence of :

  • the use of or the inability to use the Site or its content and/or to attend the Event ; or
  • the conduct or actions of any User.

 

 

Article 9 – Data Protection and Privacy

We will only use any personal information that we may collect about you in accordance with our Data Privacy Policy. Our Data Privacy Policy is available online at : www.pegase-healthcare.com/data-privacy.

By accepting these Terms and Conditions you also accept and consent to our Data Privacy Policy.

Article 10 – Termination

We may immediately terminate these Terms and Conditions with respect to you (including your access to the Site and the Event) in our absolute discretion including, without limitation, if you breach or fail to comply with any material term or provision of these Terms and Conditions. Upon termination, you must cease use of the Site and destroy all materials obtained from the Site and all copies thereof, whether made under these Terms and Conditions or otherwise.

The provisions of these Terms and Conditions, which by their nature should survive the termination of these Terms and Conditions, shall so survive such termination.

Article 11 – Miscellaneous

 

11.1. While we invite Users from all parts of the world to visit the Site and to register to the Event, you acknowledge that the Site and all services available on and through the Site are governed by and constructed in accordance with the laws of France and the courts of Nanterre, France shall have exclusive jurisdiction in respect of any actions or claims under these Terms and Conditions and you hereby consent and submit to the personal jurisdiction of such courts ; provided that nothing herein shall prevent the application and enforcement of mandatory and applicable law. We make no representation that information, content and materials on the Site are appropriate or available for use in any particular location. If you choose to access the Site you do so on your own initiative and are responsible for compliance with all applicable laws including any applicable local laws.

11.2. If any provision of these Terms and Conditions shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions. If you breach these Terms and Conditions and we take no action against you, we will not be considered to have waive our rights in respect of your breach and we will also still be entitled to use our rights and remedies in any other situation where you breach these Terms and Conditions.
